The proxy infrastructure solution provided by ElusiveProxy, which includes multiple IP addresses for connecting to the internet and tools for managing these proxies (hereafter referred to as the “System” and “Services”), is exclusively owned and operated by ElusiveProxy (hereinafter referred to as “ElusiveProxy”, “we”, “us”, or “our”). The System is designed for use in research, personal, and business contexts strictly for legal and authorised activities, as detailed in this Licence Agreement and in accordance with any relevant laws. This Licence Agreement (hereafter “Agreement”) is applicable to every version of the System, including any individual features or derived components. By selecting “Register” and creating an account for the System or by engaging with the System in any manner, you (hereinafter referred to as the “User”) affirm your comprehension of this Agreement and consent to enter a legally enforceable contract with ElusiveProxy, thereby agreeing to comply with this Agreement and the terms of an additional support services agreement (refer to the relevant document, as necessary). Utilising the System signifies the User’s unconditional and total acceptance of this Agreement’s terms. Should the User not agree to these terms, they are required to discontinue or refrain from utilising the System or any of its components immediately. Any enhancements or additional features that improve or extend the System will also fall under the purview of this Agreement. Should the User access the System on behalf of an organisation, they confirm their acceptance of this Agreement on behalf of said organisation and affirm their authority to bind the organisation to these terms.
ElusiveProxy supports the following methods for making payments: Direct payments via credit/debit/pre-paid cards. ElusiveProxy’s billing model is subscription-based, with payments made monthly. The following conditions apply: Customers may begin accessing the Services within one business day following payment of the specified fee by ElusiveProxy. Fees for 4G mobile proxy services are based on the duration of use: daily, weekly, or monthly. Customers have the option to acquire additional Services at any point. All transactions are conclusive and non-refundable. Discounts, as determined by ElusiveProxy, apply to individual purchases, and information regarding active discounts can be accessed through the user dashboard. ElusiveProxy reserves the right to modify discount policies and pricing without prior notice. Such changes will not affect pre-existing orders.
Provided the User adheres to this Agreement, ElusiveProxy grants a non-exclusive, non-transferable, revocable, limited licence to access and utilise the System and Services for lawful personal, research, and business purposes. ElusiveProxy’s pricing does not include any applicable taxes, duties, levies, or charges (such as VAT, withholding taxes, customs, etc.), which the User is responsible for paying. The User commits to abide by all applicable laws and regulations while using the System. ElusiveProxy retains the authority to discontinue or withdraw the System, any of its components, Services, or any related functionality at any time, resulting in an automatic suspension of the User’s licence to use the System or any part thereof. In such cases, ElusiveProxy is not obligated to offer refunds, benefits, or compensation to the User. We may impose or enforce restrictions on the use of the System unilaterally and without prior notice, particularly to ensure compliance with acceptable usage policies. We also reserve the right to deny access to the System, suspend Users, or restrict access at our sole discretion for any or no reason. The User assumes all risks and costs associated with using the Service, including the responsibility for the technical and functional prerequisites and electronic communication facilities needed to access and use the Service. The User also accepts the risk of loss, theft, or damage to their data. ElusiveProxy may take measures such as setting limits on specific products and/or terminating User orders or services if the User’s actions adversely affect the System, leading to overload, System failure, downtime, or performance degradation.
The following outlines a non-exhaustive list of activities prohibited on or through the System and Services. While engaging with the System and Services, you agree not to assist, encourage, or enable others to engage in the following prohibited activities (collectively referred to herein as “Prohibited Activities”): Distributing cracks, warez, ROMs, viruses, adware, worms, trojan horses, malware, spyware, or any other similar harmful software or products, or any computer code, files, or programs intended to disrupt, limit, damage, or negatively impact the operation of any computer software, hardware, or network. Causing network resources to be unavailable to legitimate users, including but not limited to through "denial-of-service (DoS)" or "distributed denial-of-service (DDoS)" attacks. Distributing illegal content or promoting illegal activities; causing harm or service interruptions to third-party computers or services. Creating or operating a competing service or entity, or assisting others in such endeavours
